Frequently Asked Questions 

We’ve compiled answers to the most common questions around: 

Employment Status

  • A: No. You are not required to move. However, continuing the contract generally requires employment with the new contractor.

  • A: The intent is to place incumbents into substantially similar roles, subject to contract requirements and qualifications.

    Service Contract Act (SCA)
    A: We are required under the SCA to offer a right-of-first-refusal for positions that are substantially similar to your current role, provided you meet the job qualifications and remain in good standing.

  • A: Your start date with Cherokee Nation Integrated Health will align with the contract transition date to ensure no break in service.

Benefits 

  • A: Benefits will differ from your current employer. You will receive full benefit details during onboarding.

  • A: Benefit eligibility and effective dates will be explained in your offer materials.

  • A: Coverage is through the new contractor’s benefit plans. Continuation of prior coverage is subject to COBRA rules. 

Clearance Requirements

  • A: Clearances will be transferred or verified as required by the contract and government customer.

Onboarding & Paperwork 

  • A: You will complete standard new-hire paperwork, which may include employment verification (I-9), tax forms, direct deposit, benefit elections, and contract-specific compliance documents.

  • A: Timing varies but is designed to ensure you are fully onboarded before the contract start date.

If I Choose Not to Transition 

  • A: If you choose not to transition, your employment with the current contractor will end per their policies.

  • A: Future opportunities may be available, subject to hiring needs.

Pay & Compensation 

  • A: Pay is reviewed individually and aligned with the new contractor’s compensation structure and contract requirements.

  • A: The goal is to remain competitive and compliant with contract labor categories and wage determinations.

    Positions covered by the SCA must comply with the applicable wage determination, including minimum hourly wages and required fringe benefits. Your specific pay details will be included in your offer letter

  • A: You will be informed of the pay schedule during onboarding. 

Time Off & Leave 

  • A: No.  When you start with Cherokee Nation Integrated Health, your PTO balance will be zero.  

    Service Contract Act (SCA)
    A: Accrued paid time off generally does not transfer between employers. However, SCA-required paid time off (PTO) and sick leave will be provided in accordance with the applicable wage determination. 

  • A: Previously scheduled leave should be disclosed during onboarding and will be reviewed. 

Seniority & Service Time 

  • A: Yes, years of service will transfer to Cherokee Nation Integrated Health

  • A: You may roll over eligible retirement funds according to plan rules; details will be provided during onboarding.

Performance & Management 

  • A: In many cases yes but reporting structures may change.

  • A: Performance records do not transfer, but your experience will be considered.
